Federal judge lets NAACP lawsuit against xAI pollution claims proceed
A federal judge in Mississippi allowed an NAACP lawsuit accusing xAI of operating unpermitted gas turbines at its Colossus data center to move forward.

Judge rejects dismissal motion
The Southern Environmental Law Center sued on behalf of the NAACP, alleging that xAI failed to obtain necessary air permits for its facility. The company argued that its combustion turbines were mobile sources exempt from permitting requirements under state law. Judge Debra M. Brown denied the motion to dismiss the case.
Clean Air Act claims stand
The plaintiffs accused xAI of violating the Clean Air Act by installing at least 35 combustion turbines without approval. The judge ruled that citizen suit plaintiffs sue on their own behalf and seek penalties to redress harm to themselves. She concluded that these actions do not violate the Constitution or private nondelegation doctrine.
