Federal judge denies xAI request to dismiss NAACP lawsuit over Memphis data center pollution
A federal judge in Tennessee has ruled that the NAACP can proceed with its lawsuit against xAI regarding alleged pollution from unpermitted turbines at a Memphis data center.

Judge rejects dismissal request
US District Judge Debra M. Brown denied xAI's motion to dismiss the legal action filed in April. The ruling allows the case to continue despite support from the Justice Department for the tech company. Judge Brown determined that the power plant supplying the turbines was not mobile and thus required permits.
Company expands turbine use
xAI continued adding gas turbines to a site in Southhaven, Mississippi while the lawsuit proceeded. The organization accuses the firm of violating the Clean Air Act by operating without proper authorization. Elon Musk's company claims its mobile equipment should be exempt from these specific permitting requirements.
