Court rejects national security claims

The judge ruled that the government lacked factual support for its assertion that revoking the passes protected national security. Kelly noted that Trump himself stated the ban was due to alleged lack of truthfulness in reporting rather than security threats. The court found no evidence that national security would be endangered if the passes were reinstated while litigation proceeds.

Due process violation cited

Judge Kelly highlighted past case law requiring advance notice and an opportunity to be heard before suspending a journalist's hard pass. He observed that letters justifying the revocation were sent after the ban occurred and after the lawsuit was filed. The administration failed to provide a sufficient explanation for the immediate suspension of credentials.

Temporary order limits enforcement

The temporary restraining order remains in effect for 14 days to preserve the status quo pending further review. Officials are blocked from enforcing the ban during this period while the court examines the case more closely. The White House and the news outlets did not immediately respond to requests for comment on the ruling.
