Court declares petition infructuous

A bench led by Chief Justice Aminuddin Khan ruled that the legal challenge was no longer viable. The judges stated that the imposition of governor's rule and an emergency in the province changed the circumstances. Consequently, the court could not proceed with hearing the case against the chief minister.

Emergency measures block proceedings

The federal government imposed these restrictions on Sunday due to the provincial administration's lack of cooperation against terrorism. Petitioner Sher Afzal Marwat admitted he also wanted to contest the emergency but requested a delay. The court noted that the chief minister no longer held office under the current arrangements.

Petitioner seeks future review

Marwat argued that the case should resume if the governor's rule is lifted in the near future. Justice Ali Baqar Najafi observed that the emergency and the chief minister's status are separate legal matters. The court dismissed the petition without addressing the broader request to challenge the state of emergency.
